Microgaming Online Casinos - Anti-online casinos ruling in New Jersey
In another example of the battles which still have to be fought to gain online casinos legitimacy in the eyes of U.S. officials, a judge in New Jersey has ruled that running an online gambling site is illegal. This ruling came down even as there is no specific state law in New Jersey, nor a federal law in the United States, which bans online gambling. Superior Court Judge Salem Vincent Ahto of Belleville wasn’t convinced by attorney Robert Dunn’s argument that “…state Legislature has never specifically passed a law that labels Internet gambling as a crime. If Nicholas Drakos, the defendant, hosted the Web site known as International Net Casino, and instructed bettors on how to set up accounts to place wagers on professional and collegiate sports events, he did so without knowing he was committing a crime.”
Judge Ahto stated, in no uncertain terms, that “Simply because the Legislature has not gotten around to directly labeling online gambling as a crime does not mean it is lawful.” Of course, said some observers, the fact that the Legislature has been unable to pass laws making online casinos gambling illegal points to the fact that there is enough popular support in the United States to allow the practice and use of online casinos there. It may not be considered lawful without a law, but without a law it shouldn’t be assumed to be bad either.
The ruling is only the latest setback for the online casinos industry in the United States, though in the last week and a half an attempt to ban online casinos from getting payments in certain ways from customers failed in the United States Senate. Too, the questionable status of online casinos in America hasn’t stopped casinos from holding tournaments to raise money for victims of Hurricane Katrina which struck the southern Gulf Coast of the United States.
